Returns
This page describes returns on birdofparadise.pt. It follows Decree-Law 24/2014, which transposes Directive 2011/83/EU, and Decree-Law 84/2021 for goods that are not in conformity. Last updated: 2 October 2026.
1. Scope
It applies to purchases on this site by consumers: natural persons acting outside their trade, business, craft or profession. It covers teas and herbal infusions, in bags or loose leaf, and accessories.
2. Right of withdrawal
You may withdraw from the contract within 14 calendar days, without giving a reason and without a penalty. That is Article 10 of Decree-Law 24/2014. The only charges that may fall on you are the direct cost of sending the goods back and, where it applies, the loss in value described below.
The period is counted from the day after the day you, or a third party you name other than the carrier, receive the goods. If the order arrives in more than one parcel, it is counted from receipt of the last item. If the last day is a Saturday, Sunday or public holiday, it ends on the next working day. Your notice is in time if you send it before that period ends.
If we did not give you this information before the purchase, the period becomes 12 months from the end of the initial period. That is Article 10(2).
3. When the right is lost
If you break the seal of a tea or herbal infusion after delivery, you lose the right of withdrawal. Sealed goods cannot be returned for the protection of health or for hygiene. That is Article 17(1)(e) of Decree-Law 24/2014.
This is not the rule for goods that go out of date quickly. Tea keeps. The exception is a seal broken after delivery. We tell you this before you pay.
A pack that is still sealed may be returned. If the tea or herbal infusion was not supplied sealed, this exception does not apply.
4. Examining the goods
You may examine the goods as you would in a shop, to check their nature, characteristics and functioning. That is Article 14. If you handle them beyond that, you answer for the loss in value. An accessory may be returned. If it is unused and fit to be sold again, the refund is the full price.
5. How to tell us
Send a clear statement to loja@birdofparadise.pt or info@birdofparadise.pt, or by post to the address below. You may use the form at the end of this page. Give your name, address, order number and the goods. You do not have to say why. You may withdraw as to some of the goods only.
Keep proof that you sent the notice. The burden of proving that you exercised the right is yours. That is Article 11(5).
6. Sending the goods back
Send the goods back within 14 days of your notice. You meet the deadline if you dispatch them before it ends. Keep them so that you can return them fit for use. Pack them so they arrive intact. A tracked parcel makes the proof easier.
You pay the direct cost of the return, because we tell you so before you buy. That is Article 4(1)(n) and Article 13(2). We do not collect the parcel. If the goods are not in conformity, the cost is ours: see section 9.

7. Refund
Within 14 days counted from the day after we are informed, we refund every payment received, including the charge for the least expensive delivery method. If you chose a dearer method, we do not refund the difference. That is Article 12(1) and (3).
The refund uses the same means of payment, unless you expressly agree otherwise, and it costs you nothing.
We may wait until we receive the goods, or until you prove you sent them, whichever comes first. We do not make a valid withdrawal depend on an inspection.
If the refund is not made within that period, the law requires the sums paid to be returned twofold, within 15 working days. That is Article 12(6).
8. Exchanges
We do not exchange one tea for another merely because you prefer a different one. In that case, place a new order. This does not limit replacement of goods that are not in conformity, described below. A clause that penalises you for withdrawing, or that makes you waive that right, is void. That is Article 11(7).
9. Goods not in conformity
A good that does not match the contract is covered by the three-year legal guarantee from delivery. That is Article 12 of Decree-Law 84/2021. This guarantee is separate from withdrawal.
If the fault appears in the first two years, it is presumed to have existed on delivery, unless that is incompatible with the nature of the goods or of the fault.
You may ask for repair or replacement. For tea, the usual path is replacement or the end of the contract. You may then ask for a price reduction or to end the contract, in the cases the law sets out. That is Article 15.
If the fault appears within 30 days of delivery, you may ask at once for replacement or to end the contract. That is the right of rejection in Article 16.
You make the goods available at our expense. Repair or replacement is free of charge and, as a rule, within 30 days of your notice. If the contract ends, we refund every payment received, including delivery, within 14 days and by the same means of payment. We may wait until the goods are back or you prove dispatch.
Write to loja@birdofparadise.pt with the order number and what is wrong, before you post the goods.

Complete and return this form only if you wish to withdraw from the contract. It follows Annex I(B) to Directive 2011/83/EU and part B of the annex to Decree-Law 24/2014. Any clear statement is enough.
